Claims for Neck Injuries

An overview of Neck Injuries

Trauma to the neck is serious and can lead to spinal cord injury and permanent disability. If trauma occurs, the neck and back should be splinted and immobilised. It is then important to establish the cause and the extent of the injury. The neck and vertebral column has many muscles and ligaments that assist in movement and protect the spinal cord. Even if a neck injury does not involve the nerves, injury to the neck structure may cause severe and debilitating pain.

However, the most common type of neck injury is whiplash. This is an injury to the soft tissue in the neck and is usually suffered by people who have been driving or passengers in vehicles which have been involved in road traffic accidents. Whiplash develops where the neck is jerked backwards and forwards in violent movements and the pain can take some time to develop.

Symptoms of Neck Injury

With a neck injury you may have tenderness and stiffness or localized pain. Sometimes the muscles on either side of the spinal column can immediately go into spasm but this reaction can be delayed by up to 24 hours.

If you have tingling, numbness, or the paralysis of an extremity this could indicate that a more serious injury may have occurred. Go straight away to you're the Accident and Emergency Department at your local hospital. If you cannot get there easily dial 999.

If the injury has penetrated the neck, immediate treatment is required. If the penetrating object remains in the neck do not remove it. Leave it in place and dial 999. The object must remain in place until a medical team can remove it.

Types of Neck Injury by severity and location.

Neck Spasm

Spasms are when the muscles in the neck contract and tighten. Re-occurring spasms can be caused by sitting at a computer for an excessive time without breaks or the result of other injury or postural problems.

If you have muscle spasm caused by the way, or the conditions in which you work, you may have the basis of a compensation claim against your employer.

Neck Strain

Neck strain is basically a tear in the muscle fibres that slide over each other to produce movements. Tears can be microscopic or more extensive and cause overstretching in the fibres or bleeding within the muscle.

These sorts of injuries are caused by sudden movements of the neck or impacts on the head - for example whiplash resulting from a car accident or contact sports. They can also be caused by excessive neck tension as sometimes seen in those who have been lifting heavy weights.

The symptoms of neck strain include pain, stiffness in the neck, headaches, dizziness and burning or pins and needles.

Neck "Stinger" Injuries

A "stinger" injury is one that affects the nerves in the neck and running down the arms. The injury can happen when the neck is suddenly forced to tilt or rotate excessively. An impact to the head can also cause a stinger injury.

The symptoms are a burning or stinging sensation in the neck, shoulders or arms and most commonly occur in contact sports such as rugby and football.

Neck Fractures

Neck fractures can easily arise from motor accidents and falls, but sports are also a significant cause of these injuries.

As the neck carries all the nerves from the brain to the rest of the body any sort of damage to the neck can have very serious implications. If the spinal cord is damaged, it can lead to paralysis below the site of the injury and even less serious fractures will cause pain, tingling, numbness and perhaps varying levels of paralysis.

Claiming Compensation following a Neck Injury

If you have suffered a neck injury as a result of an accident that was not your fault, you may be able to make a claim for compensation. The amount you can claim for will depend on the extent of the injury as well as the speed and prospects of recovery. To this will be added the costs you have incurred and compensation for any income that you have lost.

If you decide to make a claim for your neck injury, for which you will have to receive specialist independent advice. This is really important as the insurers for the party that caused the accident, are likely to pressurise you to accept a low initial offer. This is likely to be much lower than the neck injury claim is genuinely worth.
