What can I claim for?       

There are a lot of false impressions about what you can and can't claim for when you have suffered a personal injury. We'll cover the basics here, so you will know what your personal injury solicitor is talking about. Well also give you some examples of the range of compensation that certain injuries can be awarded.

Special and General Damages

You are entitled to be compensated for all the losses that you have suffered resulting from your accident. These can include damage to your property including your clothing, loss of earnings and any insurance excess you may incurred as a result of the accident. And if you have been hurt in a motor accident and your car is off the road you can usually claim for a hire car.

You should also be compensated for the suffering and pain you have experienced as a result of the accident and the resulting injury.

Finally you can also claim for any future losses you may incur. For example, your inability to work, loss of promotion prospects and perhaps your inability to take part in certain hobbies or sports.

Solicitors also like to split the amount of compensation you can receive into two separate categories called Special Damages and General Damages.  

Special Damages are all those which are easily quantifiable. For example, medical expenses, loss of earnings, ruined clothes, taxi fares, etc. Always make sure you keep a record and the receipts, of any expenses you incur. Your solicitor then can claim them on your behalf.

General Damages are more difficult to determine as these have to be "assessed". In other words, a monetary value has to be placed on the pain and suffering that you have experienced, your possible future loss of earnings and how the injury could affect your future lifestyle.

These assessments are an imprecise art. They depend much on you as an individual, your circumstances, and how you recover from your injuries. In order to get some guidance the legal profession look at past similar cases (which they call precedents) and the level of general damages awarded. They use these as a guideline and increase the figures to allow for inflation.

For example, a simple whiplash injury which causes pain and inconvenience for three to four weeks might be worth anything from £1,000 - £4,000 in general damages. In addition the Judicial Studies Board, which provides instruction and training for all the judges in England & Wales , periodically issues guidance for the assessment of General Damages in personal injury claims.
