However, the situation may be made easier if you were on of the 19 million or so who bought a package holiday. The 1992 Package Travel, Package Holiday and Package Tour Regulation makes it possible to make a claim against your holiday package company if they were in any way involved in the responsibility for your accident.

Alternatively, if you were involved in an accident whilst abroad, there is the 4th EU Motor Directive 2003. This helps victims of car accident because the directive says that all European cars have to be listed on one database. This makes it easier to identify foreign cars involved in accidents. And in the UK there is the Motor Insurers Bureau which will help identify the foreign insurer of vehicles involved in your accident.

It is a fact that every airline, holiday and tour operators, even the hotel and any other business involved in your travels has a duty of care to provide you with a safe service. Hotels have a duty to be clean and hygienic, tour operators have to ensure you're going to be safe both in your hotel and whilst travelling to and from the airport, and if you go on an excursion, that operator has to assess the risk during the planned trips in order to take suitable preventative action.

Therefore, be aware that "holiday accidents" don't just include accidents in your hotel. They cover injuries incurred whilst on aircraft, ships, boats or cruises, travel on coaches even rental vehicles and on the beach. If you partake in some action sport such as skiing or water sports, the organiser still has a duty of care no matter what disclaimers they add to their terms and conditions.
