Is there a time limit for making a claim?

This is defined by something called The Limitation Act 1980. The Act says that in actions for damages for personal injury, you have 3 years to bring a claim. But there are a number of exceptions to this which we comment on below.

The basic 3 year period runs from the date the injury occurred or from the date the person first knew that they had an injury. However the limitation period does not start until the claimant reaches the age of 18. So if the accident happened when the claimant was 16, the 3 year claim period does not start until the claimant's 18 th birthday.

Now with some injuries, the symptoms can take a long time to develop. Asbestosis is a good example of this. In such cases, the time limit runs from when the symptoms first appeared and were linked to the other party being named in the case.
