Claims for Chemical Injuries

Exposure to chemicals can ocurr in both domestic, retail and industrial settings.

Within industrial setting the three most common chemicals causeing accidents are cement, sulphuric acis and hydrofluric acid. In addition lead, arsenic, zinc and mercury can effect virtually all of the body's organs.

But even greater numbers of chemical accidents occur within non-industrial settings. For example, think of scalp injuries resulting from carelessly applied hairdressing compounds, burns from paint stripper, the inhilation of chlorine from swimming pool installations and injuries to the eyes caused by splases even caused by household chemicals.

And in some cases people were not aware that they had been exposed to chemicals, or that the chemical had been harmful. The situation can be even more complex when we appreciate that body's reaction to chemicals can be sudden or can only make themselves aparent over a long period of time. The most common "delayed" injuries that Claims Justice see, include breathing and respiratory problems like asthma, skin irritations, complaints like dermatitis, nasal complaints like rhinitis latex, allergic reactions, and certain cancers.

This can make if difficult to prove that chemicals caused the injury. But our legal beagles are experts in applying the complex regulations and laws which will help prove your case. We will also instruct the best medical experts to prove that the chemical accident actually caused your injury.

Industrial Chemical Accidents

Industrial work places using chemicals can be dangerous. Workers could be handling corrosive or toxic chemicals or gasses which could cause very serious injuries to those working within the installation (and indeed nearby). That's why such workplaces are subject to close scrutiny by the Health and Safety Executive. But despite all the regulations, accidents still happen.

Employers have a clear duty of care to employees working with chemicals as they do to any other type of worker - full risk assessments of the work place must be carried out and steps must be taken to avoid all identified risks. And this includes understanding any side effects, both immediate and delayed, associated with any of the chemicals they use in their work places or processes.

The resulting safety procedures may involve restricting the period of time in contact with chemicals and always involves the provision of full protective clothing. Each employee should also receive a preliminary personal risk assessment to identify whether he or she has a known susceptibility to any specific group of chemicals and if so, the employer must make special provision to ensure that that employee remains safe.

As we've said, the extent of a chemical injury can depend on the length of the exposure to the chemical. Sometimes, the injury will be the result of long-term exposure at a low level, so the onset of symptoms can be gradual. Some chemicals can also be slow to be removed from the body. This means that you may not be taken out of danger simply by removing yourself from the source of the chemicals. This sometimes makes chemical injury hard to diagnose.

Chemical Injuries in domestic situations

We all tend to overlook the chemicals we use in and around the home. Everyone knows that bleach and drain cleaner are dangerous substances but we use lots of other chemical in our daily lives. Take the huge range of cleaning sprays, weed killers and even wider range of hair treatments we use.

When products are known to contain potentially dangerous chemicals, they will display danger warnings and instructions on how to use them. But despite everything things can go wrong. Packing can split and your body may react badly to exposure to the chemicals despite following the safety instructions.

And we've all read accounts of ladies experiencing horrendous reactions to carelessly compounds carelessly applied at their local hairdressing salon.

It is a fact that manufacturers and those providing services to individuals still have a duty of care to ensure that any risks associated with their products and services and fully assessed and catered for. If they fail to fulfil their responsibilities they can be held liable for any injuries resulting from the accidents.
